How is Investor Identity (KYC/KYB), Accreditation, and Anti-Money Laundering (AML) Managed?

This article is for both founders and investors using Fairmint.

Fairmint enables organizations to implement comprehensive investor verification and compliance procedures through integrated identity verification systems. Know Your Customer (KYC) and Know Your Business (KYB) verification is conducted through third-party identity verification providers integrated into the platform, allowing investors to complete required identity checks during the onboarding process in accordance with applicable regulatory requirements. Upon successful completion of KYC verification, an investor's series access is automatically refreshed, allowing them immediate access to updated content without manual intervention.

Organizations may configure accreditation verification procedures to either: (i) permit prospective investors to self-certify their accredited investor status pursuant to applicable securities regulations, or (ii) require submission of documentary evidence of accreditation status (such as financial statements, tax returns, or third-party verification letters) for review and approval by the organization or its designated representatives.

When a legal entity returns to complete KYB on a new portal, previously entered company information is prefilled, reducing the need to re-enter data and streamlining the verification process.

All investor transactions are subject to automated anti-money laundering (AML) screening through integrated compliance systems that check against relevant sanctions lists, politically exposed persons (PEP) databases, and other regulatory watchlists as required by applicable AML regulations.

Organizations utilizing Fairmint software may establish custom investor eligibility criteria and maintain approved investor lists based on parameters defined in consultation with qualified legal counsel to ensure compliance with applicable securities laws and regulations.

Digital securities issued through Fairmint software may incorporate on-chain metadata regarding investor eligibility and compliance status to facilitate automated enforcement of transfer restrictions and regulatory compliance requirements. This technical architecture is designed to maintain investor privacy and data security while enabling compliance with applicable legal and regulatory obligations.
